Here is my situation:
I-485 is pending
H1 Visa will expire on Feb 26, 2009 (extension has been filed but have not received the receipt notice). Company will not file for premium processing due to budget cuts.
I have an EAD (valid until 2010) but did not renew my AP (expired this week).
I am going out of the country and will return on Feb 22, 2009.
Will there be any problems at the port of entry? Has anybody come back into the country with little time left on the H1B?

Hi,
I have applied for my wife's AP with NSC today and She needs to travel on April 3rd. I wanted to know how long does it take these days for approval?
Also, if she does not get the AP by April 3rd she would be travelling anyway. Because, I can mail her the AP once we receive even after her departure as I am going to be here in US. My question is if she travels out of the country before the approval, would USCIS know about it and would it affect her application? And if it does not come at all, can she apply for H4 stamping in India and come back on it? Please let me know guys.

My wife'e H1B expires on Feb 2007 and she still has not applied for H1B renewal as she was on maternity leave. She will do so in first week of November. It looks like H1B extension process takes more than 3 months. Virginia is one of the states which just gives ur Driver license till ur H1B validity. So her license is valid till feb 2007. Would like to know if she can get her license renewed in Feb 2007 with a H1b receipt number or should she do Premium processing of her H1B. Any help is greatly appreciated.

what makes you think that i am an anti-immigrant, and do you think that i am giving publicity. this is from an ad that i came across that says that 1.5 million immigrants are being brought into the country to work annually. i wanted to bring this to the attention of the forum so that we can do something to stop this false information propagation. otherwise, think about the hatred the american public will have when the time comes for CIR to be implemented. for every call we make, there will be 10 calls to oppose. unless we stand up and fight the misinformation, we are not going to see any progress. and maybe it is easy for you to label anyone as an anti-immigrant being an EB2. I lost out on my 2001 PD due to the mistake of my lawyer and am now saddled with a 2004 PD.
