I am in the same situation . The responses from the lawyer are Incorrect .I spoke to my companies attorney and they advised me to apply the H4 extension in Premium and then go with the new H1 in regular so that your H4 ext will be approved first and able to maintain the status until Oct 07

I have a simply question, not urgent, not immediate
I moved to a different place (same city), but my wife is out of country. I am trying to file AR-11 for change of address, but it is asking for Last Port of entry. Is AR11 needed only for people who are currently in the country.
She needs to fill-in new address in the I-94 form at the time of reentry into the US. She won't need to file AR-11, as her I-94 has most recent address.
Please verify this with your attorney.

Me and spouse got the "Card production ordered" and "Welcome notice" emails today morning.
Here is the journey:
Nov.2002 - RIR Labor filed in CA
June 2006 - Labor approved from Phily BEC
July 2006 - I-485 , I-140 filed at TSC
Sept.2006 - I-140 approved
Got stuck in namecheck ( name check may be still pending )
May 20, 2008 - RFE received for missing TB Skin test ( doctor screwed up)
June 4, 2008 - Responded to RFE
June 16, 2008 - Green card approved
Now, waiting for the actual card to arrive.

I'm a July 2007 filer going to file for my EAD for the first time. Since I'm currently on H1B, how should I answer this question
I'm applying for:
a) Permission to accept employment
b) Replacement
c) Renewal of my permission to accept employment
I think I need to go with option "c" since moving from H1B to EAD would qualify for a "c" response
Please advise.....

My lawyer said the same thing. As long as USCIS understands what is written there is no problem. He wrote annual income and send the form.

Your I - 94 Validity cannot be at a date later than H1-B. You say you got your first H1B visa till Oct 2005, but I - 94 expires in Nov 2005. I donot think it can happen
Third country Nationals can go to Mexico and get thier Visa stamped. The only thing is if your Visa gets refused for some reason, you will have to fly back to home coutry and get it stamped.
Have not heard such cases though.

You are travelling at the end of June, that means nearly 5 months from now
Here are my opinion
1) Since you are extending your H1B right now, Why can't yoy apply for premium processing?
2) Mean while Apply for EAD also. You will get in 90 days
3) For AP you can take infopass or call Customer Service -- Normally AP gets approved in 30 days. Check other threads also where others have used infopass to Expedite the case

The Priority Date box on I-140 shows the priority date alright. But the one on I-1485 is blank. Please can any one check their I-485s and let know if you are also in the same situation?

Sorry cant help you on the documentation piece.
But since your I-140 is filed, you should upgrade it to PREMIUM and try to get it approved asap.
Worst case scenario - if company B is not considered successor in interest to company A, you can still use the approved I-140 to carry over your PD.

Maybe USCIS would earn more income by telling the illegal immigrants to file EAD/I-485/Biometics every year etc.. Immigration attroneys would earn good money by replying to RFEs for 12 million immigrants. Getting this 12 million illegal immigrants legalized will surely improve the economy.
