I live in New jersey and send my EAD renewal to Nebraska based on my I-485. When i read the instructions, I found out that the application has to go to Texas based to the state where i am in now.
I would appreciate if anyone had same experience and share it with us.

I too got the soft lud's on May 21 for all of my 485. There is no change in the current status. Could that be FPs are sent or just a regular batch update? I don't know.

At last my labor is approved and I was to planning to file my 140 under PP. How ever, I am reconsidering the thought as my wife is on H4 and she is being hired on a H1B from Oct1st. If my 140 is filed under PP and approved, her H1 is approved by June/July Can I transfer my H1 to another company to port my PD? What happens to my wife's H4? I am under the impression that she needs to file an extension as well along with me. This will have her H4 approved after H1 and she will need to re validate her H1 status by going out of the country.
Is it possible that my new employer request my H1 transfer and we chose not to request my wife's extension along with mine if she has 2+ years left from the extension we received based on my previous extension? If we have to file for her extension when I transfer (which I think) PP is of no use as Oct 1st 07 is 6+ months away.

Hi,
I have an approved H1B for teaching Maths, but I got an offer for teaching ESL (I am certified in both the subject). Am I allowed to teach ESL also? Is the visa subject specific?

There were those who got their I-140 cleared under EB2 and were practically jumping with joy at the door closing behind them. Some were even taking credit for the move :)
Generally it doesnot help to stop line behind you. But here in USCIS world that may help as people from 2006 got GC before people from 2004-5 . If no people from 2006 were there may be 2004- 05 people may have got their card.
but if new administration makes USCIS to more productive ,closing door behind any one will not help.

I think you should be okay. I have like 5 H1Bs ( with all the extensions). My first name has 2 words and my last name is two words. On each h1b its different. I never had any problems in stamping so far. One I stamped from India, once mexico, couple times from DC ( this service is closed now).

I also have a similar case like the original poster (TexDBoy). I want to move from Boston area to somewhat warmer area.
I have not asked my employer if they would allow me to do this, but my family wants to really move out of Boston (too cold and tough winters). While, i do have a nice job where i see stability (I have been in the company since 8 years now), I would also like to see if I can get to some good companies in the southern places like Dallas, Austin, Raleigh, Atlanta...
What do you guys think?
The last poster mentions getting a LCA.. Does that mean we have to file another Labor? I already have labor and 140 cleared and my 485 is pending with June 2003 date (EB3)

Go to your nearest USCIS office with a copy of your application and a letter proving your emergency (if not in english, have a law office translate it). they should be able to produce an AP at the spot. My in laws just got their AP last week.

Hi Guys,
On July 2nd I have applied for my wife (EAD, AP, I485) and have waited for 3 months (October 1st) to hear that USCIS has rejected her application due to wrong fees (But we have sent them the correct fees)
My Lawyer immediately sent back the application to USCIS saying that the Check we have sent is correct and it is before increasing the fees and we haven�t done any mistake.
In the meantime on July 16th I got my 485 approved and got my GC. So now we were worried as my wife is already out of status and don�t know how long it will take now to get her receipts and how long she can stay.
I have tried calling USCIS � Every time same answer -- you have to wait, you have to wait No records in the Database. Yesterday when I called, a Lady answered the phone and she said we need to wait 90 more days again as it is like a new Submission and it was a shock for me after hearing that.
Can any body suggest me what to do in this kind of situation? Is there any body in the same situation?

Create your rectangle with the rectangle tool. Make sure you rasterize the layer first (right click on the layer with the rectangle and choose rasterize).
Now hold CTRL and click on the layer with the retangle. This will select the rectangle. Now go to Edit/Stroke.
Mess with the settings in there and voila, you have a black border around your square.

If your wife wants to transfer to a cap-subject employer, she will only be able to do so if the H-1 quota for the fiscal year has not been used up. If the H-1 cap has not been reached then transferring from a cap-exempt employer is no more difficult than transferring from a cap-subject employer. (though the new start date would have to be Oct. 1 or later)

Mine also same postion, I got my FP appointment for 11/13 at chicago but I went to LA ASC on 10/25 surprisingly they didn't bothered about date ,time and place they taken my finger prints right away. So go to near ASC. best of luck.

Previously worked on H-1B visa for six years. Left US when visa expired.
Then worked in Canada for 6 years.
Currently on TN-1 Visa with 13 years of IT Program Management and IT Project Management, IT Governance and IT Audit experience.
Looking for a company willing and able to apply for Labor Certification in this short duration, so I can apply for I-140 and I-485 before August 17th.

It depends on job duties mentioned in the LCA. For example, you might be a solution architect and this comes with experience. Some roles could be guiding junior folks, interviewing people, reviewing work done by others, project management, vendor management etc ... Essentially you need to prove your 5-year experience is worth and that is what is needed to fill your current role. Prove that this can not filled by a plain BS graduate with no experience or even a guy/girl with MS degree and no experience. DOL might be thinking why not just a BS degree or BS + 5 years = MS degree.
I am not an expert in this. Please discuss with your attorney for better advice.

As your H-1B has been withdrawn prior to your filing for the H-1B change of employer, you are now out of status. An H-1B withdrawal is technically effective immediately upon receipt by USCIS.
The best bet would be to file for a new H-1B (assuming that you did not exhaust your six years of H-1B time) under the fiscal year cap as this has not been reached.
You should notify your legal counsel of the H-1B withdrawal and see how they want to handle it. While it is true that you are currently not in status, they may have an alternate policy.

I got my receipts last weekend
It was some what similar story for me.
I my case my wife's app and mine got separated-
Mine got rejected on grounds of incorrect fees (there was a single check)
my wifes app turned up after a month or so
we refiled and got the receipts
I am now trying to find out what to expect for EAD and AP
I wonder if special handling cases get a better turnaround
Keep me posted with what happens with you- and maybe we can start to geta n ide as to what to expect next
