Starting April 1st, only two Service Center are responsible for all the I-140's, Nebraska & Texas. All I-140's are filed with Nebraska Service Center. Nebraska keeps some of the petitoins and transfers the others to Texas. The ones that NSC keeps has a receipt number starting with LIN whereas the ones that are transfered to TX has the receipt number starting with SRC. So even though the petition might be filed with NSC, chances are it might be approved sonner if it goes to TXSC. Nebraska is taking 4-5 months to approve a petition whereas TX approves it in 15-25 days.

Hi!
My H1B was filed on April 1st 2007 at Vermont Service Center while i was in India and got selected in the lottery. I came to US on May 13th on H4 visa (I 94 valid till July 18, 2008) and still my papers were under process.
On June 1st, 2007 the approval notice was sent to my employer.
Oct 1st, 2007 they applied for my change of status and on 19th it was returned back as a check for 500$ was not included.
Kindly let me know if we could go for a H1B Transfer and change of status simultaneously with a new employer.
Within what time line i need to apply for the same.

Its always safer to have an underlying non-imigrant visas such as H-1B in the vent of I-485 denial due to some unforeseen circumstances. IF you have an H-1B, you can continue to stay in the U.S.

Here is my situation.....
My EB3 140 approved with priority date 01June2002 --> Company A
My EB2 140 pending with priority date 10May2006 -->Company A (different title...future position)
Can i port my EB3 priority date (June 2002) to EB2 application & apply I-485?.If i do, will my EB3 140 gets invalid?.I will need to file 3 year H1B extn(in Oct) based on my approved EB3 application & don't want to loose my approved 140.

The portability of I-140 priority date should be done at the time the I-140 is filed. So when your EB-2 I-140 was filed, you should have requested it at that time. There is a column on the Form I-140 which asks if an I-140 was ever approved on behalf of the beneficiary.
Why don't your file your H-1B extension now using Premium Processing? It will be approved for 3 years in 10-15 days then then you can think about porting your EB-2 priority date to EB-3.

That's helpful.
So, it doesn't matter if I have GC pending with company A, and I am over 6 years on H1B. Will company B be still able to get H1B extension since my I-485 is pending(with comp A)?
